FRC legt Deloitte UK boete van £14 miljoen op inzake MG Rover

De Britse Financial Reporting Council (FRC) heeft vandaag de definitieve rapporten gepubliceerd over de tuchtzaken tegen Deloitte, de adviseurs van MG Rover, en Maghsoud Einollahi, voormalig partner bij Deloitte. Deloitte krijgt een boete van £14 miljoen en een stevige berisping. Maghsoud Einollahi krijgt een boete van £250.000 en mag drie jaar lang zijn beroep niet uitoefenen. Eerder oordeelde de Financial Reporting Council (FRC) Tribunal al dat Deloitte UK en Maghsoud Einollahi in strijd gehandeld hebben met de ethische code van het Institute of Chartered Accountants in Engeland en Wales (ICAEW). Deze beslissing van de tuchtrechter heeft betrekking op het advieswerk van Deloitte en Einollahi aan MG Rover in 2000. MG Rover ging in 2005 failliet.

Paul George, Executive Director Conduct van de FRC: ‘The final report of the Tribunal provides a clear analysis of the case and how it reached its conclusions. It should be essential reading for all members of the profession. The sanctions imposed are in line with the FRC’s aim to ensure penalties are proportionate and have the necessary deterrent effect to prevent misconduct and bolster public and market confidence.’

Deloitte zegt in een reactie ‘teleurgesteld’ te zijn over de uitspraak. Mogelijk dat de firma in beroep gaat. Een woordvoerder van Deloitte zegt: ‘We remain disappointed with the outcome of the Tribunal and disagree with its main conclusions. As a firm we take our public interest obligations seriously in everything we do. We are disappointed that the efforts we and others made did not successfully secure the long-term future of the MG Rover Group. The quality of our work, carried out more than 10 years ago, has not been criticised, but the Tribunal found against us on a number of points.’
